The World Intellectual Property Organization (WIPO), a specialized agency of the United Nations dedicated to developing a balanced and accessible international intellectual property (IP) system, provides the domain name dispute resolution services based on the Uniform Domain-Name Dispute-Resolution Policy (UDRP).
Relevant differences between the ieDRP and the UDRP include that (i) the ieDRP covers trade and service marks, reputable personal names and pseudonyms, geographical indications, which are protected in Ireland, more generally; (ii) it is sufficient to prove that either registration or subsequent use of the domain name by the registrant occurred in bad faith, whereas the UDRP requires the Complainant to prove both elements and (iii) the ieDRP includes the additional examples of evidence of registration or use in bad faith such as the likelihood of diluting the reputation of a trade or service mark and the intentional filing of misleading or false information when applying for the domain name registration. |
